Terms and Conditions
§ 1 Scope and Provider
(1) These General Terms and Conditions (GTC) govern the sale of products via the online shop of Tesunic(hereinafter referred to as "Provider") to end customers in Switzerland.
(2) Any differing terms and conditions of the buyer shall not apply unless the supplier expressly agrees to their validity in writing.
(3) By placing an order in the online shop, the buyer agrees to these terms and conditions.
§ 2 Conclusion of Contract
(1) The contracts shall be concluded exclusively in the German language.
(2) The goods offered are aimed exclusively at end customers with a billing and delivery address in Switzerland.
(3) The presentation of goods in the online shop does not constitute a legally binding offer, but rather an invitation to submit an order (offer).
(4) The buyer makes a binding offer by going through the online ordering process and clicking the “order subject to payment” button in the last step.
(5) The purchase contract is concluded as soon as the supplier accepts the order by sending a shipping confirmation by e-mailor by actually dispatching the goods.
(6) Orders are stored electronically. Upon request, the supplier will provide the buyer with a copy of the order details.
§ 3 Prices and shipping costs
(1) All prices are in Swiss francs (CHF) including VAT and statutory taxes (where applicable).
(2) Shipping costs will be shown separately during the order process.
(3) The buyer shall bear any customs duties and import charges, handling fees charged by transport service providers (e.g. postal services, courier services) and any customs clearance costs.
(4) If a product is incorrectly priced, the supplier will inform the buyer. In this case, the buyer can either confirm the contract at the corrected price or cancel it free of charge.
§ 4 Payment Terms
(1) Payment can be made using the payment methods offered in the online shop (e.g. credit card, PayPal, Twint, Klarna, etc.).
(2) The purchase price is due immediately upon completion of the order.
(3) The provider reserves the right to exclude certain payment methods.
§ 5 Delivery and Retention of Title
(1) Delivery within Switzerland will be made to the delivery address specified by the buyer.
(2) Delivery time is usually 5–14 working days, but may vary in individual cases. Delays do not automatically entitle the customer to withdraw from the contract.
(3) Ownership of the goods remains with the supplier until full payment has been received.
§ 6 Right of withdrawal and return (specifically for Vita patches)
(1) In Switzerland, there is no statutory right of withdrawal. However, the supplier voluntarily grants a right of return of 60 days from receipt of the goods.
(2) The return of goods is conditional upon the goods being in unused and undamaged condition in their original packaging.
(3) Hygiene products, opened cosmetic products or individually ordered goods are excluded from the right of return.
(4) Return shipping costs shall be borne by the buyer.
(5) For Vita-Patches (herbal knee patches), the voluntary right of return applies only to a customer's first order . The right of return is excluded for all subsequent orders . This is to prevent misuse and ensure product safety.
§ 7 Warranty and Liability
(1) The statutory warranty applies (2 years). In the event of a defect, the supplier may, at its own discretion, repair, replace, or refund the purchase price.
(2) The buyer's liability claims are limited to cases of intent and gross negligence. For slight negligence, the supplier is only liable for breaches of essential contractual obligations (cardinal obligations).
(3) The supplier is not liable for improper use or application of the products. Instructions on the product packaging or in the product description must be observed.
Section 8 Data Protection
(1) The provider processes the buyer's personal data in accordance with applicable data protection regulations.
(2) Details can be found in the privacy policy, which is available in the online shop.
§ 9 Jurisdiction and applicable law
(1) Swiss law shall apply exclusively.
(2) The place of jurisdiction for all disputes arising from contractual relationships is the registered office of the provider, unless mandatory law provides otherwise.
§ 10 Final Provisions
(1) Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
(2) Amendments and additions to these Terms and Conditions must be in writing.
§ 11 Information on Vita-Patches (herbal knee patches)
(1) Vita-Patches are herbal and natural products developed to support general well-being and to relieve minor ailments. They do not replace medical diagnosis, treatment, or therapy . In the case of existing or acute illnesses or pain, a medical examination and treatment are always necessary.
(2) The use of Vita-Patches is at your own risk . The provider accepts no liability for health problems, complaints or adverse reactions arising from the use of the products.
(3) Before applying the product over a large area, it is recommended to carry out a spot skin test to rule out possible allergic reactions or intolerances to individual ingredients.
(4) People who are already allergic to certain ingredients or who suffer from skin diseases should not use the products or should consult a doctor beforehand.
(5) The supplier points out that skin reactions such as redness, itching or irritation may occur in rare cases. If such symptoms occur, use should be stopped immediately.
(6) The effects of the Vita Patches described are based on general experience and the traditional, herbal properties of the ingredients (e.g., wormwood, ginger oil, pepper, menthol, camphor). They are not medically proven claims of healing .
(7) The supplier accepts no liability for damages or consequences arising from improper application, overdose, prolonged or excessive use, improper storage or combination with other products.
(8) Packaging, product description and advertising material serve solely to provide information about the ingredients and the recommended use . They do not replace medical advice or diagnosis.
(9) By ordering the Vita-Patches, the buyer expressly acknowledges that he has read and understood these instructions and that the application is at his own risk.
